BINDING TARIFF INFORMATION
Binding Tariff Information (BTI) is a legal act issued by the Customs Administration for the classification of goods under the Customs Tariff, in accordance with Article 19 of the Customs Law. BTI is issued on the basis of a written request submitted by the interested party on the form provided in Annex 1 of the Regulation on the Implementation of the Customs Law.
A BTI is issued on the basis of a written request submitted by the interested person on the form provided in Annex 1 of the Regulation Implementing the Customs Law.
The application should only refer to one type of goods and is considered complete and properly completed if it contains all the data required for the issuance of a BTI.
Depending on the type of goods, if necessary, the request shall be accompanied by a manufacturer's specification (original and translation), technical documentation, brochures, photographs, samples or other available documents containing data necessary to make a decision on the classification of the goods in accordance with the Customs Tariff.
If the Customs Administration determines that the application is incomplete and does not contain all the necessary data for the issuance of a BTI, it may request the applicant to submit the missing necessary data.
The legally stipulated deadline for issuing a BTI is three months and begins to run from the moment the Customs Administration has all the necessary data for issuing a BTI.
If the BTI cannot be issued within three months from the date of acceptance of the duly submitted application, the Customs Administration will notify the applicant of the reasons for the delay and will indicate the deadline within which it considers it will issue it.
The BTI is valid for three years from the date of issuance.
